Interstar Chim S.A. (hereinafter referred to as “Interstar Chim” or “us”), a Romanian legal person, with headquarters in Bucharest, Sector 3, Bd. Basarabia no. 256, has developed this Privacy Policy to explain how we process and protect your personal data.

To whom does this Policy apply?

This policy applies to the processing of personal data of:

Visitors to our sites igienol.roand www.interstar.ro (“Visitors”);
People who sign up for our marketing campaigns (“Campaign Participants”);
Our contractual partners such as suppliers, customers (“Business Partners”);
Candidates at Interstar Chim’s available jobs.

What data do we collect about you?

We collect and process your personal data as follows:

from the information you provide us by filling in the contact forms on our websites;
from the information you provide us for participating in our marketing campaigns;
by phone, e-mail or in any other way of communication.

The information you provide may include the name, address, e-mail address and telephone number, as well as other information, as the case may be.

Through our activity on the site, we will not collect or process sensitive personal data related to you (e.g.: information about racial or ethnic origin, political opinions, religious confession or philosophical beliefs, health, sexual life or sexual orientation) unless in case:

We are obliged to do so by law; and / or
if you have given us your explicit consent separately.

If you voluntarily provide us with personal data (including sensitive personal data) through your interaction with www.igienol.ro and www.interstar.ro or by contacting us by phone, e-mail or in any other way, by your own will and not at our request, we will be able to delete such personal data from our systems unless we consider their processing to be necessary for a legitimate purpose of Interstar Chim.

What are the purposes of the processing of personal data and what is the legal basis for the processing?

We can process your personal data in the following cases:

for communication purposes when it is necessary to answer any requests received through the contact forms on the websites igienol.roand www.interstar.ro, by phone, e-mail or in any other way;
for communication purposes when awarding prizes as a result of campaigns run by Interstar Chim;
for communication purposes when we need to take the necessary steps to conclude a contract with you or the company you represent;
for communication purposes when we have to execute a contract that we have concluded with you or with the company you represent;
for legal purposes when complying with a legal obligation.

When requesting personal data to comply with legal or contractual obligations, the provision of such personal data by you is mandatory. This means that if such personal data is not provided, we will not be able to manage the contractual relationships or comply with the legal obligations imposed on us. In all other cases, the provision of personal data is optional and you are under no obligation to provide them.

We may process your personal data, such as identification data, contact details, and address of residence, in order to allow our rights to be exercised in the future. This processing is based on our legitimate interest, and we need to exercise our rights in the event of possible litigation.

Visitors:

When it is necessary to respond to the possible requests received through the contact forms on the websites www.igienol.ro and www.interstar.ro, we may use your personal data provided (name, surname, e-mail address or other personal data provided in the body of the message).

This processing is based on our legitimate interest in knowing the person to whom we address the response.

Campaign participants:

As part of the marketing campaigns run by Interstar Chim that have the purpose of awarding prizes, we will collect and process personal data about you such as: name, surname, e-mail address, telephone, to identify and award the prizes.

This processing is based on our legitimate interest in knowing the person to be awarded with the prize.

Commercial partners:

For the purpose of concluding or executing contractual relationships with Interstar Chim’s trading partners, as the administrator or the person’s representative, we may process personal data such as: name, surname, e-mail address, telephone.

This processing is based on:

executing a contract to which you, as an administrator or representative of the business partner, are a party;
legal obligations imposed on us;
our legitimate interest.

Being a Business Partner, we can provide you with communications about our new products and services. If you no longer wish to receive these communications, you may opt-out by sending us an e-mail to dpo@interstar.ro.

Job candidates:

In regard with your participation in the recruitment and selection process for one or more jobs mentioned as available within Interstar Chim, we may collect and process your personal data (for example, CV data that you send it to us) for the purpose of selecting, assessing the professional competencies for the workplace you apply and for communicating with you during the recruitment process.

This processing is based on your intention to conclude a work contract with Interstar Chim and the legitimate interest of Interstar Chim.

We will not transmit your personal data to third parties for marketing purposes without your express consent to that effect.

To whom do we transmit your personal data?

Interstar Chim will not transmit (by selling or renting) your personal information to third parties.

Within Interstar Chim, only a limited number of staff members have access to your personal data on a need-to-know basis. Interstar Chim staff members have the right to manage the personal data only on the basis of the instructions provided by Interstar Chim in regard with their job responsibilities.

Your personal data may be communicated to governmental authorities, tax authorities and / or law enforcement agencies if required by applicable law or if necessary for the exercise of our rights, including the conditions of use, or for the protection of our legitimate interests (including the legitimate interests of third parties) in accordance with the applicable laws.

Your personal data may also be disclosed to third parties as follows:

To business partners, suppliers and subcontractors for the execution of all the contracts we conclude with you in order to provide the products and services requested by you;
To service providers that provide administrative, professional and technical support to Interstar Chim;
To external consultants (ie lawyers, accountants, auditors) for specific purposes, when necessary.

Interstar Chim performs a prior assessment on the selection of third party service providers and requires these service providers to maintain adequate technical and organizational security measures to protect personal data and process personal data only in accordance with the instructions specified by Interstar Chim. Service providers will have the right to use subcontractors to provide services to Interstar Chim, provided that each subcontractor respects the same data protection obligations as service providers.

What is the period for keeping personal data?

We will keep your personal data for the period necessary to meet the purposes listed in this Policy or for the period required by applicable national law, in accordance with the applicable legal minimum retention periods and / or as necessary to exercise our legitimate rights ( and the legitimate rights of others).

If your personal data has been collected as part of your voluntary subscription to Interstar Chim’s campaigns, we will retain your data for a maximum of 90 days after the end of the campaign.

If you are a commercial partner, we will keep your personal data in the course of our contractual relationship with you.

If you are a candidate for one or more jobs published by Interstar Chim, we will keep your personal data throughout the recruitment and selection process plus a period of five years after completing the recruitment process (if the candidate was not employed in the company).

Transfer of personal data outside the country

During storage within Interstar Chim, your data may be accessible and / or transferred outside the country to the Interstar group.

What rights do you have?

You have the following rights under the relevant legislation:

The right of access the personal data and to confirm whether your personal data is processed by us and to provide you a copy of your personal data;
The right to request the rectification or deletion of personal data;
The right to request restriction of the processing of personal data;
The right to oppose the processing of personal data;
The right to request portability of personal data;
The right to withdraw your consent at any time without affecting the legality of the processing under consent prior to its withdrawal;
The right to submit a complaint to the National Supervisory Authority for Personal Data Processing.

Confidentiality of minors data

The websites www.igienol.ro and www.interstar.ro do not knowingly collect personal identification data from people who have not reached the age of 16. If the parent or legal representative is aware that the child in custody provided his / her personal data to www.igienol.ro and www.interstar.ro, he / she must immediately inform Interstar Chim at the e- mail dpo@interstar.ro. If we find that a person under the age of 16 has provided personal data through www.igienol.ro and www.interstar.ro, then we will destroy this information from our servers immediately , unless the parent or the legal representant explicitly consents to the site’s processing of the child’s personal data for the specified purposes.
